What you get, what it costs you to leave, and what we will never do to your mail.
These are enforced by the software, not described by a sales page. Prices live on the pricing page, because they are the part that moves.
Losing a card should not lose you a decade of mail. A failed payment costs you features, never messages.
The same sequence whether you cancel deliberately or a payment quietly fails.
One rule, really: this is a mailbox for a person or a company, not a machine for sending mail to strangers.
These terms are an agreement between you and MZED Studio Limited, a company registered in England and Wales under number 15854033, with its registered office at 8 Eastfield Close, Townhill, Swansea, Wales, SA1 6SG. We trade as Nyxe.
By creating an account you accept them. If you are agreeing on behalf of a company, you are confirming you are allowed to.
You need to be at least 16. Keep your sign-in details to yourself, and tell us if you think someone else has them. Anything done through your account is treated as done by you.
If your mailbox belongs to an organisation, its administrators control it: they can create, suspend and remove members, and the organisation owns the addresses.
Paid plans are billed in advance through Stripe, monthly or annually, until you cancel. Team plans are billed per seat with a minimum of two, and adding a seat mid-term is charged for the rest of that term. Prices exclude VAT where it applies.
Cancel any time and you keep what you paid for until the end of the period you have paid for. We do not refund the unused part of a term after that, except where the law says we must.
If you are a consumer in the UK or EU you have 14 days from signing up to change your mind. Ask within that window and we will refund you, less anything you have already used.
You own everything you put into Nyxe. You give us permission to store, transmit and display it, and nothing else: only what is needed to actually run a mailbox. We do not use it to train anything, sell it, or show you advertising.
You can export the whole mailbox as a standard .mbox file whenever you like, without asking us and without paying for it.
We do not read your mail. There are two exceptions and they are narrow: when you ask us to look at something as part of a support request, and when the law requires it. If we are compelled by a legal request we will tell you, unless we are forbidden from doing so.
If an account breaks the rules above we will normally tell you and give you a chance to put it right. Where something is actively harmful, unlawful or damaging the service for other people, we may suspend it first and explain afterwards.
A suspension is not a deletion. Unless the law requires otherwise, we will give you a reasonable chance to export your mail before anything is removed.
You can close your account at any time. Deletion is immediate and permanent, so export first: we cannot undo it and we do not keep a copy waiting for you to change your mind.
We can end this agreement with 30 days' notice, and we would refund the unused part of anything you had paid. If we ever shut Nyxe down, you would get a long notice period and an export, not an email on the last day.
We will run the service with reasonable skill and care, and we take mail delivery seriously. What we cannot promise is perfection: no mail service is up every minute, no mail service controls whether someone else's server accepts a message, and spam filtering everywhere is a judgement call that sometimes gets it wrong.
So the service is provided as it is. Free accounts come with no uptime commitment at all. Keep your own backup of anything you truly cannot lose, which is why export is free and always available.
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. If you are a consumer, your statutory rights are untouched by any of this.
Otherwise, and to the extent the law allows, we are not liable for lost profits, lost business or indirect losses, and our total liability is capped at what you paid us in the twelve months before the claim.
We may change these terms. The date at the top changes with them, and if a change materially affects you we will email you at least 30 days before it takes effect. Carrying on using Nyxe after that means you accept it; if you would rather not, cancel and we will refund the unused part of your term.
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere in the UK or in the EU, you keep the protection of your own country's mandatory laws and can bring a claim in your local courts.
